The website https://mystorse.com (”The Site”), MyStorSe is an application which provides an online marketplace (“Application”) where registered suppliers (“Suppliers”) can offer to sell their products to Customers of Application., These Terms along with the Privacy Policy published on the Platform (“Privacy Policy”) and other policies (as may be notified/displayed/published on the Platform) constitutes the contract between the Users of this Platform and Company (collectively “Agreement”). As a visitor to the Site you are advised to please read the Term & Conditions carefully. By accessing the services provided by the Site you agree to the terms provided in this Terms & Conditions document.

General Terms and Conditions

Your Account

All shoppers have to register and login for placing orders on the site. You have to keep your account and registration details current and correct for communications related to your purchases from the site. If you use the website, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer to prevent unauthorised access to your account. You agree to accept responsibility for all activities that occur under your account or password. You should take all necessary steps to ensure that the password is kept confidential and secure and should inform us immediately if you have any reason to believe that your password has become known to anyone else, or if the password is being, or is likely to be, used in an unauthorised manner. Please ensure that the details you provide us with are correct and complete and inform us immediately of any changes to the information that you provided when registering. You can access and update much of the information you provided us with in the Your Account area of the website. You agree and acknowledge that you will use your customer account on the website to purchase products only for your personal use and not for business purposes. If found any unlawful usages of the account, MyStorSe reserves the right to refuse access to the website, terminate accounts, remove or edit content at any time without notice to you.

By agreeing to the terms and conditions, the shopper agrees to receive promotional communication and newsletters upon registration. The customer can opt out either by sending email to unsubscribe@mystorse.com or by contacting the customer service.

Who can Use:-

Services of the Site would be available to only select geographies in India. Persons who are “incompetent to contract” within the meaning of the Indian Contract Act, 1872 including un-discharged insolvents etc. are not eligible to use the Site. If you are a minor i.e. under the age of 18 years but at least 13 years of age you may use the Site only under the supervision of a parent or legal guardian who agrees to be bound by these Terms of Use. If your age is below 18 years your parents or legal guardians can transact on behalf of you if they are registered users. You are prohibited from purchasing any material which is for adult consumption and the sale of which to minors is prohibited.

Vendor:-

(i). The website is currently under a test mode, where the vendors are added on a trial/testing basis.

(ii). MyStorSe will provide various membership plan which will have benefits according to the tier. And the vendor is at his/her liberty to choose.

(iii). Test mode is for one month duration. Where vendors are charged nothing for the services by MyStorSe. After the test mode, if vendors wish then they can continue with the available membership plans. New vendors who were not entitled to test mode, will get the trial of the MyStorSe services, after which they can select any membership plans to continue.

(iv). Vendors can create and list products on MyStorSe, the pricing mechanism is the domain of the Vendor. MyStorSe can provide pricing data for better management of the same.

Pricing

All the products listed on the site will be sold at MRP unless otherwise specified by the vendor. The prices mentioned at the time of ordering will be the prices charged on the date of the delivery/pickup. Although prices of most of the products do not fluctuate on a daily basis but some of the commodities and fresh food prices do change on a daily basis. In case the prices are higher or lower on the date of delivery no additional charges will be collected or refunded as the case may be at the time of the delivery of the order.

Pickup Policy :

Items once ordered should be picked up within 2 days, else the order stands cancelled. If the order is paid, then it will be refunded back to customer with 7-8 working days. If the vendor has any pickup policy, then the vendor policy will hold true.

Shipping Policy :

MyStorSe do not have any shipping/delivery service. The shipping/delivery is handled by the vendor itself and if the vendor requests, then the 3^rd party delivery service provider will be attached to requested vendor. The shipping policy of the vendor or the 3^rd party vendor will apply accordingly.

Return & Refunds

We have a “liberal refund policy” which is covered under various heads.

Pickup- Customers opting for pickup should check the products at the store itself. No return will be accepted after the products are picked up.

Delivery- Customers can return damaged or expired products at the time of delivery but once the delivery is accepted products will not be taken back.

Once the Return is accepted the customer will be able to exchange the products for similar items or they will be issued store credits which can be used to pay your subsequent shopping bills.

If the vendors have their own shipping and refund policy then the products will be subjected to vendor shipping and refund policy. The policies of the respective vendor holds good.

Website Communication.

You agree, understand and acknowledge that the website is an online platform that enables vendor to list their products and on the other hand enables the website customer to purchase products listed on the website at the price indicated therein at any time from any location. You further agree and acknowledge that MyStorSe is only a facilitator and is not and cannot be a party to or control in any manner any transactions on the website. Accordingly, the contract of sale of products on the website shall be a strictly bipartite contract between customer and the vendor on mystorse.com.

Surveys and Contests

From time to time, MyStorSe(One8 Solutions) holds competitions and conducts surveys to our customers and users and get more insights on our services and products. The results of these surveys are used to improve our services and to add more value added features. Ongoing Surveys in could be found at MyStorSe Surveys page and the same is posted at our social media handles, invite maybe sent personally through emails or mobile messages and by pamphlets.

Users / Customers who have accepted an invitation to join the survey and agreed to share their thoughts and ideas with us through surveys and other feedback mechanisms so that we canput them at the heart of the products and services we create. Contest / Survey participation is, at all times is voluntary.

This section describes the terms and conditions surrounding the participation in MyStorSe competetions and surveys. All references to “MyStorSe” and/or “Sponsor” shall collectively include MyStorSe.

1. Survey Entries

Unless otherwise stated, entries are open to all the users of MyStorSe and new individuals with only one entry per person.

2. Coupons and Gifts

MyStorSe, at its sole discretion, may offer various incentives in exchange for feedback. This can include exclusive MyStorSe coupons and thankyou gifts. These items are non-transferable and no substitution is allowed.

3. Contests and Prizes

MyStorSe, at its sole discretion, may also offer a chance to win a prize based on a competition and/or random drawing. Where prizes are competition-based, participants agree and acknowledge that the determination of the competition winner is made solely by MyStorSe, unless otherwise stated.

Announcement of winner(s) will be made according to timelines stated within the specific contest and generally occur within 30 days after the contest closes.

MyStorSe employees and MyStorSe independent contractors are ineligible for prize based competitions and drawings.

4. Use of Survey Feedback

Unless otherwise stated, participants’ feedback via surveys may be used for either internal purposes and/or the results may be ananymized and shared publicly. Participants agree that their feedback maybe used by MyStorSe in either manner.

5. Participants Obligations

The following additional participant obligations apply :

(i). Money-transfer / Cash coupons : Where the prize involves a money transfer or cash coupons, it is the winners’ responsibility to provide details required by MyStorSe (such as an address) in order to deliver the prize. Participants agree the failure to do so may result in forfeiture.

(ii). Taxes : All the Central, State and Local taxes associated with the receipt or use of any prize is solely the responsibility of the winner.

(iii). Release and Waiver : By participating in a MyStorSe Contest/Survey you agree to release, discharge and hold MyStorSe harmless from and against any and all liability, loss, injuries or damages associated with the participation in the contest or the acceptance, possession, use or misuse of any prize received in the Contest/Survey. By parricipating in a MyStorSe Contest/Survey, you agree to waive all rights to claim punitive, indirect, incidental and consequential damages, attorneys’ fees or any damages, other than actual out-of-pocket costs incurred to participate.

6. Additional Rules

Participants agree to these additional rules.

(i). Right to terminate : MyStorSe reserves the right to terminate, suspend or amend any Contest/Survey, without notice, and for amy reason, including, without limitation. If MyStorSe determines that the contest cannot be conducted as planned or should a virus, bug, tampering or unauthorized intervention, technical failure or other cause corrupt the administration, security, fairness, integrity of the Contest/Survey.

(ii). Right to Void Entries : MyStorSe further reserves the right to void entries that are suspect, in the event of tampering or unauthorized intervention

(iii). No Liability For Errors/Omissions : MyStorSe is not responsible for any typographical or other errors in the offer or administration of a Contest/Survey, including, but not limited to, errors in any printing or posting of the contest, the selection and announcement of any winner, or the distribution of any prize. In addition, MyStorSe is not responsible for any human error, technical malfunction, lost or delayed data transmission, failure or malfunction of any telephone network, computer equipment or software, or the inability to submit a feedback entry for any reason.

Fair Usage Policy

We always strive hard to provide the best experience to our customers on the platform. To ensure that all customers use our platform in good faith, we keep track of customer behaviour which includes maintaining order history and other details relating to the manner of use of our platform. In the event of any abuse of our platform or the policies, which include excessive returns or refusal to accept shipments which are not otherwise wrong or defective, actions such as levying a service fee, discontinuing various benefits, etc. may be undertaken to address such issues. Customers whose profiles indicate high volumes of valid transactions on the platform may be offered benefits by vendors, from time to time, based on their discretion and policies.

Reviews, comments, communications and other content

Users of this website may post reviews, comments and other content; send communications; and submit suggestions, ideas, comments, questions, or other information, as long as the content is not illegal, obscene, abusive, threatening, defamatory, invasive of privacy, infringing of intellectual property rights, or otherwise injurious to third parties, or objectionable and does not consist of or contain software viruses, political campaigning, commercial solicitation, chain letters, mass mailings, or any form of “spam.” In the event a user uses a false e-mail address, impersonates any person or entity, or otherwise misleads as to the origin of any content. MyStorSe reserves the right (but not the obligation) to remove, refuse, delete or edit any content that in the sole judgement of MyStorSe violates these Conditions of use and, or terminate your permission to access or use this website. You are and shall remain solely responsible for the content of any Comments you make, and you agree to indemnify MyStorSe and its affiliates for all claims resulting from any comments you submit. MyStorSe and its affiliates take no responsibility and assume no liability for any comments submitted by you or any third party.

MyStorSe will be entitled to use, reproduce, disclose, modify, adapt, create derivative works from, publish, display and distribute any comments you submit for any purpose whatsoever, without restriction and without compensating you in any way.

Intellectual Property Claims

MyStorSe and its affiliates respect the intellectual property of others. If you believe that your intellectual property rights have been used in a way that gives rise to concerns of infringement please write to us in our registered e-mail contact@mystorse.com

Trademarks

mystorse.com and other marks indicated on our website are trademarks or registered trademarks of MyStorSe, MyStorSe graphics, logos, page headers, button icons, scripts and service names are the trademarks or trade dress of MyStorSe. MyStorSe trademarks and trade dress may not be used in connection with any product or service that is not MyStorSe, in any manner that is likely to cause confusion among customers, or in any manner that disparages or discredits MyStorSe.

All other trademarks not owned by MyStorSe that appear on this website are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by MyStorSe and are protected by Indian and international copyright laws. The compilation (meaning the collection, arrangement, and assembly) of all Contents on this Website is the exclusive property of MyStorSe and is also protected by Indian and international copyright laws.

Governing Law and Jurisdiction

This User Agreement shall be construed in accordance with the applicable laws of India. The Courts at Bangalore shall have exclusive jurisdiction in any proceedings arising out of this agreement. Any dispute or difference either in interpretation or otherwise, of any terms of this User Agreement between the parties hereto, the same shall be referred to an independent arbitrator who will be appointed by MyStorSe and his decision shall be final and binding on the parties hereto. The above arbitration shall be in accordance with the Arbitration and Conciliation Act, 1996 as amended from time to time. The arbitration shall be held in Bangalore. The High Court of judicature at Bangalore alone shall have the jurisdiction and the Laws of India shall apply.

Can the terms of this Agreement be modified?

Users can review the most current version of the Agreement at any time on the Website. MyStorSe reserves the right to unilaterally update, change or replace any part of the Agreement by publishing updates or changes on the Platform and such amended provisions of the Agreement shall be effective immediately upon being posted on the Platform.

It is the responsibility of the Users to check this page periodically for changes. The Users’ continued use of or access to the Application following the posting of any changes constitutes acceptance of those changes.

Any such termination of the User Agreement shall not cancel your obligation to pay for the product already ordered from the Website or affect any liability that may have arisen under the User Agreement.
